CRIMINAL EXPUNGEMENTS
Brent's experience regarding expungement, sealing, and sequestration of criminal records dates back to the time he worked as an Assistant Attorney General at the Arkansas Attorney General's Office. While there, he drafted legislation concerning criminal expungement laws and worked with other criminal justice agencies to formulate a package of legislation primarily addressing the procedural aspects of expungement. That package became law when it was passed by the Arkansas Legislature in the mid-1990's.
Since that point in time, Brent has been active in writing about and teaching on the subject of criminal expungements. He has written a legal outline on criminal expungements and most recently wrote an article on expungements which appeared in the Fall 2010 issue of The Docket, a quarterly publication of the Arkansas Trial Lawyer's Association. Brent is frequently consulted by attorneys and others within the criminal justice arena when they have a question about expungements. He is currently a member of a standing committee, consisting of representatives of criminal justice agencies in Arkansas, who have been meeting to formulate a new legislative package on criminal expungements for upcoming legislative sessions. Ultimately, the goal of the committee is to formulate a simplified and comprehensive expungement law to propose to the legislature in future legislative sessions.
Brent has represented numerous clients and helped them obtain a sealing of their criminal records. The office prepares and files all of the necessary documentation associated with the expungement and appears at a hearing if necessary. Brent has been successful in obtaining expungement of records even where the State has opposed the request.
UPDATE--Under a relatively new legislative act, an individual can have their record sealed and expunged even though at the time of their disposition they were not sentenced under an act that authorized expungement. This includes misdemeanor DWI offenses which could not be expunged prior to passage of this act.
